Terms of Service

These Terms of Service (“Terms”) govern your use of the Five Fox Creative Dashboard (the “Service”), provided by SIA Five Fox Media (“Five Fox Media”, “we”, “us”), a company registered in Latvia. By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Service is a private performance-analytics tool that presents paid and organic marketing data across TikTok, Meta (Facebook and Instagram) and Google. It displays analytics for accounts that have been connected with the account owner’s authorization. It is read-only with respect to connected social accounts and does not post or make changes on them.

2. Eligibility and accounts

The Service is intended for businesses and their authorized personnel. You must be at least 18 years old and authorized to act for the accounts you connect. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.

3. Connecting third-party platforms

When you connect a TikTok, Meta or Google account, you authorize us to access data from that account through the platform’s official API, solely to provide the Service. Your use of those platforms remains subject to their own terms and policies, including the TikTok Terms of Service. You may disconnect a platform, or revoke access from within that platform, at any time. Our handling of the data we access is described in our Privacy Policy.

4. Acceptable use

You agree not to:

• use the Service unlawfully or in violation of any third-party platform’s terms;
• attempt to access data or accounts you are not authorized to access;
• interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure;
• reverse engineer, resell, or misuse the Service or the data it presents.

5. Intellectual property

The Service, including its software, design and content (excluding your data and third-party platform data), is owned by Five Fox Media and protected by applicable laws. These Terms do not grant you any rights in it except the limited right to use it as permitted here.

6. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind. Analytics are derived from third-party platform data and may be incomplete, delayed or inaccurate. We do not warrant that the Service will be uninterrupted or error-free.

7. Limitation of liability

To the maximum extent permitted by law, Five Fox Media will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or profits, arising from your use of the Service.

8. Termination

We may suspend or terminate access to the Service at any time, including for breach of these Terms. You may stop using the Service and disconnect your accounts at any time. Provisions that by their nature should survive termination will survive.

9. Governing law

These Terms are governed by the laws of Latvia, without regard to conflict-of-laws rules. Disputes will be subject to the competent courts of Latvia.

10. Changes

We may update these Terms from time to time. We will change the effective date above when we do, and continued use of the Service after changes take effect constitutes acceptance.
